Acquiring A Large Sum Of Money

Due to a variety of life circumstances, people sometimes find themselves acquiring a large lump sum of money—whether that’s through an equity payout from an employer—or another life event such as an inheritance or selling a house or small business.

Q: If someone receives a large divorce settlement, how should he or she manage investments, a budget and a single income?

A: This is a big life change that often comes with a lot of emotion; you shouldn’t try to navigate it alone. In our opinion, it is important to work with a wealth advisor who can help you create a wealth plan that includes a cash flow strategy so you can monitor income and expenses. Meeting with an advisor periodically can help ensure you are on track to reach your goals.

Your wealth advisor will work alongside our in- house investment team to ensure your portfolio is diversified and aligns with your risk tolerance and time frame toward meeting goals.

Q: What are the most important first steps people should take if they inherit money due to the death of a parent or spouse?

A: Most mistakes are made by moving too quickly. In our opinion, you won’t regret taking time to determine the best use of the inheritance through a financial plan by meeting with your wealth advisor to minimize taxes (where applicable) on an inheritance and set goals for how you want to preserve or invest this newfound wealth.

If you don’t already have one, create an emergency fund. If you already have one, add to it so that you have six months or more in savings should you need it. Some individuals purchase something special to remind them of their loved ones who have passed, or they create a special memory with their family.

Q: What are the tax implications individuals should consider when inheriting money?

A: When an inheritance is received, the following types of tax should be considered—estate and inheritance taxes and income taxes. An estate tax may be assessed if the taxable value of the estate for an individual or couple exceeds a specified annual limit. This tax is paid by the estate and reduces how much the heirs receive. An inheritance tax requires beneficiaries to pay taxes on assets they’ve inherited. There is no inheritance tax at the federal level, but there are a handful of states that impose the tax.

Income taxes may not be an immediate factor for those who inherit assets, as the assets revalue themselves to market value on the date the owner dies. However, inherited assets held within retirement accounts (401(k), traditional IRA, etc.) do not receive this revaluation, and any distributions from these accounts will typically be taxed to the recipient. You should work closely with your tax professional and wealth advisor to help maximize the total value you receive from these types of inherited assets.

Q: If someone is considering selling a house or small business, who should he/she consult about managing the process and the financial implications?

A: You should consult both your wealth advisor and your tax professional very early in the process. Planning can be crucial during this transition. You’ll need to determine how much of the proceeds you’ll receive and how much you’ll owe in taxes, especially if you have reached a higher tax bracket. Having this information in advance can help to eliminate emotions and an unexpected tax problem.

7 Common Estate Planning Mistakes to Avoid

Simply stated, estate planning is the process of developing and implementing a “master plan” to facilitate the distribution of your assets after your death. Life isn’t static, so it’s a good idea to revisit your estate plan regularly and update it when necessary. Just as important, you’ll want to avoid these 7 common estate planning mistakes:

Failing to use your full estate tax exemption
Not having a lifetime trust in place
Neglecting to maximize GST-exemption and other estate planning tools
Lack of trust flexibility in planning for wealth transfer
Not using proper ownership structures
Selecting the wrong location to establish your trust
Choosing the wrong trustee

1. Failing to Use Your Full Estate Tax Exemption

The lifetime federal estate tax exemption in 2024 is $13.61 million for individuals and double that, $27.22 million, for married couples.¹ That means your heirs avoid paying taxes on estates that fall below those thresholds—for now.

On Jan. 1, 2026, the federal exemption will revert to their pre-2018 levels and will be adjusted for inflation. To make the most of the higher exemption thresholds before they expire, consider working with your legal team to set up trusts, make gifts or utilize other estate planning tools appropriate for your personal situation.

2. Not Having a Lifetime Trust in Place

Many people assume all trusts offer protection from creditors. But there are several different types of trusts, each providing different levels of control, protection and outcomes. Often, trusts stipulate that distributions of principal be made when beneficiaries reach a certain age (for example, at 35, 45 and 55 years old).

Any distribution from a trust may expose those assets to creditors and, if not properly segregated, could become marital/community property and see half possibly lost in a divorce.

To protect against these undesirable outcomes, irrevocable lifetime trusts are an attractive strategy for safely passing wealth to future generations. Lifetime trusts:

Provide greater creditor protection for beneficiaries by keeping assets in an irrevocable trust during their life
Typically have distribution standards that protect beneficiaries from wasting trust assets
Allow the grantor to control how the beneficiary is able to utilize their inheritance
Offer greater creditor protection if controlled and managed by an independent corporate trustee

Although lifetime trusts are not for everyone, they are generally ideal for high-net-worth individuals who want to protect their assets or use their estate exemption and parents who are concerned about their children’s financial decision-making.* Additionally, they can help shield assets from current or expected creditors.

3. Neglecting to Maximize GST-Exemption and Other Estate Planning Tools

One way you can take advantage of current federal estate tax exemption amounts is to set up a generation-skipping trust (GST), which allows transfers of $13.61 million (individuals) or $27.22 million (married couples) in 2024 directly to the GST for the benefit of grandchildren without triggering federal GST taxes.² Like the estate tax exemption, the GST tax exemption is due to sunset in 2026.

Another strategy for preserving family wealth is a family bank. A family-funded entity, it offers financing only to family members or family-owned assets and enables you to create a family legacy while supporting entrepreneurship, offering flexibility and potentially reducing inequity in future generations. Alternatively, you may want to consider establishing a private trust company, which provides fiduciary and trustee services to a single-family group and creates a process around the stewardship of your wealth.

4. Lack of Trust Flexibility in Planning for Wealth Transfer

If not designed properly, trusts can lack the flexibility required to plan dynastically. It’s essential that any trusts you set up are flexible enough to adapt to changing times, circumstances and tax laws.

For example, you’ll want any trust you have created to provide for:

Changing the trust situs, or moving a trust from one state to another
Decanting, which allows for the distribution of assets from an old trust to a new one
Establishing a trust protector, who has powers over the trust but is not the trustee
Splitting a trust into two or more separate trusts, or combining two or more separate trusts into a single trust
Removing or replacing trustees
Providing for an optional power of appointment

5. Not Using Proper Ownership Structures

The ownership structure of your assets could have long-term implications for estate planning, taxation and asset protection. That’s because whether an asset forms part of your estate is directly related to how it is owned. Three key ownership structures include sole ownership, joint ownership and tenants in common.

Proper structuring of assets can:

Reduce their fair market value and reduce estate taxes
Provide greater control of investments
Simplify administration
Enhance liquidity control

6. Selecting the Wrong Location to Establish Your Trust

Trust creators and beneficiaries can choose to live anywhere. However, a trust is a “resident” of, and is governed by, the state where the trustee (either an individual or institution) is located. For that reason, establishing your trust in a state whose laws are favorable to the type of trust you want to set up is important.

States that have put in place beneficial trust legislation include Alaska, Delaware, Florida, Nevada, New Hampshire, South Dakota, Tennessee and Wyoming. As you weigh the location for your trust, states’ statutes regarding trust flexibility, asset protection and taxes may also be key factors in your decision.

7. Choosing the Wrong Trustee

Oftentimes, the choice of a trustee is not given the deliberation it deserves. After all, the role of trustee comes with considerable responsibilities as well as significant potential liability.

Trust creators frequently turn to family members in the belief that they, more than friends or third parties, are best suited to make decisions concerning trust assets that eventually will be distributed to other relatives. But given the time and knowledge the role of trustee requires, a corporate trustee may be a better option.

Corporate trustees are regulated by external agencies and internal auditors and are covered by liability insurance in the event of a mistake. What’s more, a corporate trustee is a neutral party that administers the trust in an unbiased manner, minimizing the potential for family conflict.

Are You Planning for Taxes Year-Round?

We recommend discussing proactive tax planning with your wealth advisor and tax professional throughout the year to help ensure you’re investing and taking any withdrawals from retirement accounts in the most tax-efficient way possible. Here are strategies to consider ahead of filing your taxes.

Benefits of Tax Deductions

To better understand the tax-mitigation strategies available, it’s helpful to understand “above-the-line” and “below-the-line” tax deductions. Above-the-line deductions, also known as “adjustments to income,” are subtracted from your total income. They help lower your adjusted gross income (AGI) and thus your taxable income. Above-the-line deductions take their name from the fact that they appear above the line on tax forms where AGI is calculated. Below-the-line deductions, also known as itemized deductions, are subtracted from your AGI to arrive at your taxable income.

While above-the-line deductions are available to all taxpayers, below-the-line deductions can only be taken if you choose to itemize your deductions and the total amount of those deductions exceeds the standard deduction. For 2023, the standard deduction is $13,850 for single filers and $27,700 for married couples filing jointly.¹ Standard deduction amounts are slightly higher for those over age 65.

Health Savings Accounts (HSAs)

Contributions to an HSA are a good example of an above-the-line deduction. HSAs, which must be paired with high-deductible health insurance policies, are triple tax free: Contributions reduce your taxable income in the year in which you make them, while interest, dividends and capital gains are free from tax, as are withdrawals used to pay for qualified medical expenses. HSAs are especially valuable if you can avoid drawing on the assets, which allows them to compound over many years. For 2023, the HSA contribution limits are $3,850 for self-only coverage, and if you have family coverage you can contribute up to $7,750.² Individuals who are age 55 and older can contribute an additional $1,000 as a catch-up. In addition, after age 65, you can use HSA funds for anything you like, not just eligible medical expenses.

Traditional IRA

If you have earned income, contributions to traditional IRAs are another above-the-line deduction. For 2023, the maximum total contribution allowed is $6,500, or $7,500 if you’re age 50 or older.³ Note that the ability to deduct your contributions may be limited based on your income and whether you or your spouse are covered by a retirement plan at work. Single taxpayers covered by a workplace plan and earning above $83,000 can’t deduct contributions. For married couples where both spouses are covered by a workplace plan, deductions disappear above $136,000. With just one spouse covered by a workplace plan, the deduction phases out at $228,000.⁴

401(k) or Other Qualified Retirement Plan

Contributions to qualified retirement plans, such as 401(k)s, 403(b)s and 457s, are another form of above-the-line deduction, as contributions to these plans reduce your taxable wages. Individuals can contribute $22,500 in 2023.⁵ For those over age 50, catch-up contributions allow you to contribute up to $30,000. Contribute as much as you can even beyond the employer match to help maximize your pre-tax and retirement savings.

Charitable Contribution Strategies

While cash contributions are the most common method of charitable giving, you should consider other strategic options that may provide more powerful tax savings. One strategy is to donate appreciated assets, such as securities, artwork or real estate, to qualified charities. The donor receives a charitable deduction for the full, fair market value of the gifted assets. If those assets were held for more than a year, they are not subject to capital gains taxes.

Establishing a donor-advised fund (DAF) is another option. By transferring assets to the fund, donors receive an immediate tax deduction in the year donated and can recommend grants from the fund to qualified charities over time. Another strategy would be to “bunch” your charitable contributions in high-income years. This can be accomplished with direct contributions to charities or by using a DAF.

Qualified Charitable Distributions (QCDs)

QCDs can potentially save thousands in taxes every year. If you’re age 70½ or older, you may make tax-free transfers of up to $100,000 per year directly from your IRA to a single or multiple qualified charities. The amount will be excluded from your taxable income.⁶ Additionally, the distribution counts toward your required minimum distribution.

Mortgage-Interest Deductions

Mortgage-interest deductions are another tax-minimization tool. Married couples can deduct the interest on mortgages up to $750,000.⁷ One way to amplify the mortgage-interest deduction is by making an extra payment on your mortgage before the end of the year, if allowed by your mortgage lender.

Investment Interest Expenses

You might also benefit from writing off investment-interest expenses. These include fees paid to borrow money to invest in securities or margin interest paid on a brokerage account. Note that these expenses can’t exceed the amount of investment income earned.

Deferring or Accelerating Income

Managing when you receive your income may help you lower your taxable income, either immediately or over multiple years. For example, high earners who expect their income to decrease after this year may wish to defer compensation or bonuses until next year so that they don’t take a huge tax hit this year. On the other hand, they may want to consider accelerating income into the current tax year if they expect their income to increase significantly next year.

Consult With Your Wealth Team

There are many other tactics and strategies you can use to limit your pain when tax time rolls around again. What’s most important is to use the intervening months to proactively plan.

Keith provides financial planning and investment management to individuals, foundations and endowments. He works within our P&G advisory team and has experience in working with current, former and retired Procter & Gamble employees to walk through their benefits and develop a tax-efficient retirement paycheck. Prior to joining Mariner Wealth Advisors, Keith worked in various roles within the commercial banking world where he spent time working closely with individuals on their financial goals.

He has a bachelor’s degree in finance from the University of Dayton.

Personal Interests

Keith is an active member of the community is a graduate of Cincy Next, Class 5. Outside of work, he enjoys spending time with his wife and can be found on the golf course on most weekends.

Experience and Education

With more than 15 years of investment and wealth planning experience, Patrick delivers broad-based wealth management services for high-net-worth individuals and families. He has experience working with the Procter & Gamble community and other Fortune 500 company executives and employees, where his knowledge of retirement plan distribution strategies, portfolio construction and stock option planning creates a tailored experience for his clients.

Prior to joining Mariner Wealth Advisors, he was a vice president and private banker with J.P. Morgan’s Private Bank high-net-worth office in Cincinnati serving on the executive wealth team. In this position, he worked alongside J.P. Morgan’s Retirement Plan Services Group. Patrick developed an understanding of various profit sharing plan distribution strategies, stock option awards, restricted stock grants and appropriate planning techniques to help minimize taxes and reduce concentration risk. Previously, he was a vice president and banker at J.P. Morgan Chase’s Private Client Group in Chicago where he was responsible for investment relationships, customizing asset allocations, and he worked comprehensively, advising clients on investments and retirement, estate and tax planning.

He has a bachelor’s degree in business administration from The University of Florida.

Personal Interests

In his spare time, Patrick enjoys road biking, mountain biking, boating, waterskiing and watching his three kids’ sporting events.

Experience and Education

Keith focuses on the client experience and developing associate talent at several of our locations. He is responsible for strategy and operational execution in these locations, as well as identifying and opening new offices. He also specializes in helping corporate executives and business owners navigate the various complexities that impact their families and long-term financial goals.

Prior to joining Mariner Wealth Advisors, Keith spent six years as a lead financial advisor at Capstone Financial Advisors. In that role, he advised clients through the financial planning process, including tax planning, wealth transfer strategies, small-business planning and investment management. While at Capstone, he became a partner and served on the firm’s management committee, where he helped direct strategy related to growth initiatives and new client acquisitions. Before serving as a lead financial advisor, Keith was a financial analyst at Capstone. He also completed a two-year internship as a financial analyst in the Public Finance Department at Robert W. Baird & Co.

Keith has a bachelor’s degree in accounting and finance from North Central College.
